Momčilo Mandić sentenced to five years imprisonment, Milorad Govedarice sentenced to two years imprisonment

Proceedings conducted before the Appellate Division of the Court of BiH, Section II for Organized Crime, Economic Crime and Corruption, were completed on 29 March 2007 by a final Decision upon the appeals filed by the Accused Momcilo Mandic and his defense counsel, and by the Accused Milorad Govedarica filed through his defense counsel, against the Verdict of the first-instance panel of the Court of BiH, which in its convicting part included the convictions against the Accused imposing on them respective sentences of imprisonment, and upon the appeal filed by the BiH Prosecutor's Office against the part of the Verdict whereby Milovan Bjelica and Mirko Sarovic were acquitted of the charges that they had committed the criminal offense of Abuse of Office or Official Authority under Article 337 (4) in conjunction with Article 3 of the CC RS.

The Verdict handed down by the first-instance panel of the Court of BiH, no. KPV-02/06 dated 27 October 2006, sentenced the Accused Momcilo Mandic for the commission of the continued criminal offense of Abuse of Office or Official Authority under Article 337 (4) in conjunction with Article 3 of the CC RS and the criminal offense of Forging of Official Document under Article 364 (1) of the same Code, to a compound sentence of nine-year imprisonment; while the Accused Milorad Govedarica was sentenced for the commission of the continued criminal offense of Abuse of Office or Official Authority under Article 337 (4) in conjunction with Article 3 of the CC RS, to a compound sentence of four-year imprisonment.

Deciding upon the filed appeals, the Appellate Division of the Court of BiH refused as unfounded the appeal filed by the BiH Prosecutor's Office, while it partly granted the appeals filed by the Accused Momcilo Mandic and his defense counsel, and the Accused Milorad Govedarica filed through his defense counsel, by reversing the convicting part of the first-instance Verdict of the Court of BiH and acquitting the Accused Momcilo Mandic of certain clauses of the Indictment falling under the scope of the continued criminal offense of Abuse of Office or Official Authority, finding that the specific actions were not legally sanctioned as criminal offenses, so it accordingly reversed the decision on the punishment, handing down a compound sentence of five-year imprisonment.

With regard to the Accused Milorad Govedarica, the Appellate Division reversed the convicting part of the first-instance Verdict in the part referring to meting out the punishment, and sentenced him to a two-year imprisonment.
