Trial Verdict revoked in the case v. Mario Šego et al. and re-trial ordered

The Panel of the Section II for Organized Crime, Economic Crime and Corruption of the Appeals Division of the Court of Bosnia and Herzegovina sent out on 23 April 2015 the Decision dated 09 March 2015 under which the Prosecution appeal is granted and the Trial Verdict No. S1 2 K 013147 13 K dated 21 October 2014 is revoked and re-trial before the Panel of the Appeals Division is ordered.

Trial Verdict modified in the case v. Nikola Šego et al.

Deciding upon appeals by the Prosecution and Defense Counsel for the Accused Nikola Šego, Mirko Šekara and Enis Ajkunić filed from the Verdict of the Court of BIH dated 18 June 2012, following the Decision of the Constitutional Court of BIH, the Panel of the Section II for Organized Crime, Economic Crime and Corruption of the Appeals Division of the Court of Bosnia and Herzegovina sent out on 21 April 2015 the Appeals Verdict dated 22 December 2014 under which the appeals of the Defense for the Accused Nikola Šego, Mirko Šekara and Enis Ajkunić are refused as unfounded while the Prosecution appeal is upheld and the Verdict No. S1 2 K 003346 10 K dated 18 June 2012 is modified in terms of the decision as to the sanction in as much as the Accused Nikola Šego, Mirko Šekara and Enis Ajkunić are sentenced to three years in prison each. The Trial Verdict remains unchanged in the remaining part.

Branko Vlačo sentenced to 13 years in prison

The Panel of the Appellate Division of Section I for War Crimes of the Court of Bosnia and Herzegovina sent out, on 27 April 2015, a second instance Verdict in the case of Branko Vlačo, refusing as ill-founded the appeal filed by the Prosecutor's Office of Bosnia and Herzegovina from the Verdict of the Court of BiH of 4 July 2014, and granting, in part, the appeal filed by the accused Branko Vlačo. Thus, the convicting part of the referenced Verdict was revised with regard to the legal qualification of the offense, and the Accused’s acts, enumerated in the convicting part of the contested Verdict, legally qualified as the criminal offense of Crimes against Humanity (by persecution) under Article 172(1)(h) of the Criminal Code of BiH (CC BiH), as read with Article 180(1) of the Criminal Procedure Code BiH (CPC BiH). With regard to the decision on sentence, the Trial Verdict was revised in the way that, applying Articles 39, 42, 48 of the CC BiH, the accused Branko Vlačo was sentenced for the referenced criminal offense to a prison sentence for a term of 13 (thirteen) years. Pursuant to Article 56 of the CC BiH, the time the Accused spent in custody shall be credited towards the prison sentence imposed.

Aleksandar Vuković and Dejan Amidžić Conclude Plea Agreement

After deliberation on and acceptance of the plea agreement concluded on 28 April 2015, the Panel of Section II for Organized Crime, Economic Crime and Corruption of the Court of Bosnia and Herzegovina rendered and on 12 May 2015 publicly announced a verdict finding the Accused Aleksandar Vuković, the Accused Dejan Amidžić, the accused legal entity Forteco d.o.o. Trn Laktaši, and the accused legal entity Marija d.o.o. Bosanski Brod, guilty of the criminal offense of Organized Crime as read with the continued criminal offense of Tax Evasion. The Court, therefore, imposed on the Accused Aleksandar Vuković a sentence of imprisonment for the term of 1 (one) year, on the Accused Dejan Amidžić a suspended sentence of imprisonment for the term of 1 (one) year which will not be executed unless the Accused commits a new criminal offense within 2 (two) years from the day the Verdict becomes final and binding, and imposed on the accused legal entities Forteco d.o.o. Trn Laktaši and Marija d.o.o. Bosanski Brod the punishment of dissolution of the legal entities.
Eso Macić sentenced to a prison term of 11 years

Acting upon the Constitutional Court of Bosnia and Herzegovina Decision No: AP-4613/12 of 17 March 2015, which overturned the second-instance verdict No. S1 1 K 002594 13 Krž3 of 13 June 2013 delivered by the Court of BiH in the part relevant to the application of a milder criminal law, the Appellate Division Panel of the Court of BiH sent out on 24 April 2015 the Verdict issued on 16 April 2015, under which the second-instance Verdict No: S1 1 K 002594 13 Krž3 of 21 October 2010 was revised in the part relevant to the application of a milder criminal code and in the sentencing part. The offenses of which Eso Macić was found guilty under the first instance Verdict were qualified as the criminal offense of War Crimes against Civilians in violation of Article 142(1) of the Criminal Code of the Socialist Federal Republic of Yugoslavia, adopted pursuant to the Law on Application of the Criminal Code of BiH and Criminal Code of SFRY, as read with Article 22 of the same Law. Consequently, the Court revised the Verdict in the sentencing part too and imposed on the accused Eso Macić a prison sentence of 11 (eleven) years. Pursuant to Article 50 of the CC of SFRY, the time the Accused spent in custody and serving his sentence under the final Verdict of the Court of BiH is to be credited towards his prison sentence.
Vitomir Racković sentenced to 12 years in prison

Following the completion of the main trial, on 11 May 2015 the First-Instance Panel of Section I for War Crimes of the Court of Bosnia and Herzegovina handed down a verdict finding the accused Vitomir Racković guilty of the criminal offense of Crimes against Humanity under Article 172(1)h) (Persecution) of the Criminal Code of Bosnia and Herzegovina (CC BiH), all in conjunction with Article 80(1) and Article 29 of the same Code. In that regard, the Court of BiH sentenced the accused Racković to 12 (twelve) years of imprisonment.

Deciding upon the Motion of the Prosecutor's Office of Bosnia and Herzegovina to order custody, the Court of Bosnia and Herzegovina rendered the Decision dated 08 May 2015 declaring the Court of Bosnia and Herzegovina not in jurisdiction as to the subject matter for the criminal procedure against Bahir Imamović, suspected of the criminal offense of Receiving Gifts and Other Forms of Benefit in violation of Article 380(2) of the Criminal Code of Federation of BIH.
