Having deliberated upon a motion by the Prosecutor's Office of Bosnia and Herzegovina /BiH/ seeking continuation of pre-trial custody of the suspects in Hasan Dupovac et al., the Court of Bosnia and Herzegovina /Court of BiH, Court/ issued a Decision on 28 April 2021, granting in part the motion by the Prosecutor's Office BiH and continuing the pre-trial custody of suspects Hasan Dupovac and Zijad Mutap ordered by a Decision of the Court of BiH dated 3 February 2021 and continued by, respectively, a Decision of the Court of BiH dated 25 February 2021 and a Decision of the Appellate Division of the Court of BiH dated 11 March 2021.
The pre-trial custody has been continued for additional two months and may last no longer than 28 June 2021 or a new decision of the Court. The pre-trial custody has been continued on the grounds of Article 132 Paragraph Sub-Paragraphs (b) and (d) of the Criminal Procedure Code of Bosnia and Herzegovina /CPC BiH/, namely due to a fear that the suspects will destroy, conceal, alter of falsify evidence of clues relevant to criminal proceedings or if particular circumstances indicate that they will hinder the criminal proceedings by influencing witnesses, accessories or accomplices, and this is a criminal offense punishable by imprisonment for a term of 10 years or more affecting safety of citizens and property.
The appeal filed by counsel for the suspect Josip Barić against a Decision of the Court of BiH dated 23 April 2021 (ordering the suspect into pre-trial custody) was dismissed as ill-founded, whereas the appeal by the Prosecutor's Office of BiH was granted and the said decision reversed by ordering the suspect Josip Barić into pre-trial custody on the grounds of Article 132(1)(d) of the CPC BiH as well.
Hasan Dupovac and Zijad Mutap are suspected of committing the criminal offense of Organized Crime under Article 342(1) and (2) and (d) of the Criminal Code of the Federation of Bosnia and Herzegovina /CPC FBiH/, in conjunction with the criminal offenses of Accessory After the Fact under Article 346(2) of the CC FBiH and Illegal Interceding under Article 382(2) thereof.
Josip Barić is suspected of committing the criminal offense of Organized Crime under Article 342(1) and (2) of the CC FBiH, in conjunction with the criminal offense of Accessory After the Fact under Article 346(1) of the CC FBiH.
