On 7 December 2018, the Court of Bosnia and Herzegovina confirmed the indictment charging the accused Dušan Cimeš with the criminal offense of Crimes against Humanity under Article 172(1)h) as read with Subparagraphs a), d), e) and k), and Article 173(1)a), all in conjunction with Article 180(1) of the Criminal Code of Bosnia and Herzegovina.
The indictment stated that the accused Dušan Cimeš, during the war in Bosnia and Herzegovina, in the framework of a widespread and systematic attack launched by the military and police of the Serb Republic of Bosnia and Herzegovina, subsequently Republika Srpska, which lasted from 23 May 1992 in the territory of the Ripač community, and from 10 June 1992 in the remaining territory of the Serb municipality of Bihać, to the end of 1992, aimed against the Bosniak civilian population in the territory of the Serb municipality of Bihać, knowing of the attack and that his actions constituted part thereof, in his capacity as Head of the Ripač-based Public Security Station of the Serb municipality of Bihać, and also as a member of the Crisis Staff, or the War Presidency, of the Serb municipality of Bihać, knowingly participated in the joint criminal enterprise with the common purpose to ethnically cleanse the territory of the Serb municipality of Bihać from the Bosniak population that lived there, by way of persecution on ethnic and religious grounds, so they committed the persecution of the Bosniak population on ethnic and religious grounds by way of deportation and forced transfer of population, detention and other serious forms of deprivation of liberty in violation of the basic rules of international law, by killings, attacks on civilian population and settlements, which resulted in the death and serious bodily injuries and other inhumane acts of similar nature, committed with the aim of inflicting great suffering or serious physical or mental injury and violation of health.
