Commencement of trial before the Appellate Panel in the Marko Radić et al. case

Commencement of trial before the Appellate Panel of Section I for War Crimes of the Court of Bosnia and Herzegovina (BiH), in the Marko Radić et al. case has been scheduled for 6 July 2010, starting at 1:00 p.m. in Courtroom 6.

On 14th April 2010 Panel of the Appellate Division of the Court of Bosnia-Herzegovina sent out the decision granting the appeals filed by the Defence revoking the first-instance verdict of 20th February 2009 and ordering a hearing to be held before the Appellate Panel.

By the first-instance Verdict of this Court of 20th February 2009, the accused Marko Radić, Dragan Šunjić, Damir Brekalo, and Mirko Vračević were found guilty of the criminal offence of Crimes against Humanity in violation of Article 172(1)(h), in conjunction with Subparagraphs (a), (e), (f), (g), and (k), in conjunction with Article 29 and 180(1) of the Criminal Code of BiH. With respect to the foregoing criminal offence, the following prison sentences were imposed on the accused: the accused Radić was sentenced to long-term imprisonment of 25 years, the accused Šunjić to long-term imprisonment of 21 years, the accused Brekalo was sentenced to long-term imprisonment of 20 years, and the accused Vračević to a prison sentence of 14 years.

In the retrial, which is to be conducted before the Appellate Panel, the essential violations of the criminal procedure will be eliminated; evidence that was already tendered will be reheard and new evidence adduced as necessary, and thereafter a new verdict, based on the law, rendered.
