In its motion for custody, the Prosecutor’s Office of BiH submits that there is grounded suspicion that Suspect Gani Kovači is a member of an organized group of people who carried out the transportation of foreign citizens who did not meet the requirements for a legal entry into BiH or for a legal stay therein. The transfer of persons was allegedly carried out from the Republic of Montenegro across the territory of BiH to the Republic of Croatia, with the aim of further transportation to the countries of Western Europe. Being a member of the organized group of people, the Suspect allegedly took part in the international sale, interceded in the international sale, and took part in the illicit trafficking and delivery of substances-narcotic drugs. The Suspect, as alleged in the Prosecutor’s Motion to order custody, during 2007 and 2008, in an organized fashion, along with other members completed the purchase of at least 10kg of narcotic drug – marihuana, and took part in the transfer of a significant number of smuggled persons from the Republic of Montenegro into Bosnia and Herzegovina.
Having reviewed the evidence submitted, the Court concluded that there was grounded suspicion that the Suspect had committed the criminal offence in question. Further, the Court ordered custody having found that there was sufficient evidence indicating that the Suspect, if released, might hinder the criminal proceedings by influencing witnesses, accessories, or accomplices.
