Nihad Bojadžić ordered into custody

Deciding upon the Motion of the Prosecutor's Office of BIH, the Court of Bosnia and Herzegovina issued the Decision in the case v. Nihad Bojadžić ordering the Accused Nihad Bojadžić into one-month custody due to the circumstances that suggest the risk of flight. Under the said Decision, custody may last until 28 May 2013 or a different decision of the Court.

 

Under the same Decision, the Court granted the Motion of the Defense and accepted the bail in the amount of KM 746,658.00 which consists of the entry of mortgage on a real estate and so the Accused Nihad Bojadžić shall be released after he submits to the Court the final Decision allowing the entry of the mortgage on the designated real estate to the benefit of the Budget of Bosnia and Herzegovina.

 

After the mortgage-related requirements for the release are met, the Accused Nihad Bojadžić is ordered the following prohibiting measures:  

 

1.     Ban on leaving the place of residence – the officials of the relevant police department will visit his residence on a daily basis;

2.     Travel ban - including the seizure of travel documents, prohibition of issuance of travel documents, as well as the prohibition to use the identity card for crossing the State border of Bosnia and Herzegovina;

3.     Ban on meeting and contacting the witnesses in the criminal proceedings and other persons who have any knowledge about this case.

 

The imposed prohibiting measures may last as long as necessary, while the review of their justifiability shall be carried out on a bimonthly basis.

 

If the Accused violates any of the imposed prohibiting measures, he may be ordered back into custody.

 

Nihad Bojadžić is charged with the criminal offense of War Crimes against Civilians and War Crimes against Prisoners of War.
