Verdict delivered in the Prce and others case

The trial panel of Section II for Organized Crime, Economic Crime and Corruption of the Court of Bosnia and Herzegovina today delivered its verdict in the case of Miroslav Prce and Dragan Čurčić.

The indictment charged Miroslav Prce and Dragan Čurčić with the criminal offense of undermining the military and defensive power pursuant to Article 144 of the Criminal Code of the Federation of Bosnia and Herzegovina (CC FBiH). It further charged Miroslav Prce with the criminal offense of abuse of office or official authority, pursuant to Article 358 of the CC FBiH.

The panel found the accused Miroslav Prce guilty of the criminal offense of abuse of office or official authority.  The Court found that the accused, in his capacity as the Minister of Defense of the Federation of BiH, issued a decision in 2001, withdrawing the Croatian Defense Council (HVO) from active service.  This caused damage in an undetermined amount to HVO and the Ministry of Defense of the Federation of BiH. The panel sentenced the accused Miroslav Prce to one year and six months imprisonment. Taking into account an earlier sentence, pronounced by the Court of BiH in case No. KPV-13/04, issued on 30 September 2004, the Court sentenced the accused Miroslav Prce to a joint sentence of six years imprisonment. The panel found the accused Miroslav Prce and Dragan Čurčić not guilty on the other count of the indictment (criminal offense of undermining the military and defensive power pursuant to Article 144 of the CC FBiH).
