Miodrag Marković sentenced to 6 years of imprisonment

The Appellate Division Panel of the Court of Bosnia and Herzegovina, with regard to the Decision issued by the Constitutional Court of Bosnia and Herzegovina No. AP-929/12 of 17 March 2015, overturning the verdict of the Court of Bosnia and Herzegovina No. S 1 1 K 003426 10 Krl (Ref. X-KRŽ-07/442) of 27 September 2011, in the part pertaining to the application of the more lenient criminal code, on 15 April 2015 sent out the Verdict dated 9 April 2015 reversing the second-instance verdict of the Court of Bosnia and Herzegovina No. S1 1 K 003426 11 Krž of 27 September 2011 in the part concerning the application of substantive law and the sentencing decision, so that the actions Miodrag Marković was found guilty of by the first-instance verdict were legally qualified as a criminal offense of War Crimes against Civilians under Article 142(1) of the Criminal Code of the Socialist Federative Republic of Yugoslavia (CC SFRY), adopted pursuant to the Law on the Application of the Criminal Code of Bosnia and Herzegovina and the CC SFRY. The Court of BiH sentenced the accused Milorad Marković to 6 (six) years of imprisonment. Pursuant to Article 50 of the CC SFRY, the time he spent in custody and serving his sentence under the final verdict of the Court of BiH shall be credited towards his ultimate sentence.

Panel of the Section II for Organized Crime, Economic Crime and Corruption of the Appeals Division of the Court of Bosnia and Herzegovina sent out on 17 April 2015 the Decision granting the appeal of the Prosecutor's Office of BIH, revoking the Trial Verdict No. S1 2 K 015635 14 K dated 9 December 2014 and ordering a re-trial before the Panel of the Appeals Division of the Court of Bosnia and Herzegovina.

Panel of the Section II for Organized Crime, Economic Crime and Corruption of the Appeals Division of the Court of Bosnia and Herzegovina sent out on 27 March 2015 the Decision granting the appeals of the Prosecutor's Office of BIH, Defense Counsel for the Accused Fahrudin Čago and Defense Counsel for the Accused Enes Pašalić, and in line with Article 309 of the CPC of BIH the Verdict of the Court No. S1 2 K 002641 12 K dated 21 July 2014 is revoked in relation to other Accused persons as well. In its convicting part and a re-trial before the Panel of the Appeals Division is ordered. Panel of the Section II for Organized Crime, Economic Crime and Corruption of the Appeals Division of the Court of Bosnia and Herzegovina sent out on 27 March 2015 the Decision granting the appeals of the Prosecutor's Office of BIH, Defense Counsel for the Accused Fahrudin Čago and Defense Counsel for the Accused Enes Pašalić, and in line with Article 309 of the CPC of BIH the Verdict of the Court No. S1 2 K 002641 12 K dated 21 July 2014 is revoked in relation to other Accused persons as well. In its convicting part and a re-trial before the Panel of the Appeals Division is ordered. As for the dismissing part of the Verdict which was not subject of the appeals, the Verdict remains unchanged.

At a plea hearing before the Section II for Organized Crime, Economic Crime and Corruption of the Court of Bosnia and Herzegovina, the Accused Mesud Begić, Arif Čović, Almir Čović, Đulaga Čović, Hasib Čović, Ale Čović, Safet Šabić and Emir Recep Secgin entered a not guilty plea.
Igor Bogojević pronounced a suspended sentence of six months in prison

Following the review and acceptance of the Guilty Plea Agreement, the Judge of the Section II for Organized Crime, Economic Crime and Corruption of the Court of Bosnia and Herzegovina handed down and pronounced on 24 April 2015 the Verdict under which the Accused Igor Bogojević is found guilty of the criminal offence of Tax Evasion in violation of Article 210(1) of the Criminal Code of Bosnia and Herzegovina (CC of BIH). To that regard, the Court pronounced the suspended sentence of six months imprisonment which will not be executed unless the Accused commits a new criminal offense or does not pay the ill-gotten property gain of BAM 13,563.00 in the operational period of one (1) year from the day the Verdict becomes final and binding.

On 22 April 2015 the Court of Bosnia and Herzegovina issued a decision to deny the Prosecutor’s Motion to order custody of the suspects Zijad Nanić, Esad Kudelić, Nedžad Bapić, Senad Salkić, Hasan Mustafić and Samir Isaković, instead imposing on them the prohibitive measures as follows:

On 22 April 2015 the Court of Bosnia and Herzegovina issued a decision granting the Prosecutor’s Motion to order one-month custody against the suspect Vahid Bajrektarević. According to the decision, custody may last until 22 May 2015 or until a new decision of the Court.
