Branimir Glavaš sentenced to eight-year imprisonment

After its session and acting upon a petition of the Ministry of Justice of the Republic of Croatia to take over the execution of the sentence of imprisonment of the convicted Branimir Glavaš, the Court of Bosnia and Herzegovina delivered and dispatched the Verdict finding Branimir Glavaš guilty of the criminal offense of War Crimes against Civilians in violation of Article 173(1)(a) and (c), as read with Article 180(1) of the Criminal Code of BiH. Pursuant to the foregoing, the Court imposed on Branimir Glavaš the sentence of imprisonment for a term of eight years. At the same time, the Court ordered the accused into custody which may last no longer than nine months or until a new decision of the Court.

 

By the final Verdict of the District Court in Zagreb dated 8 May 2009, Republic of Croatia, the convicted Branimir Glavaš was found guilty of the criminal offense of War Crimes against Civilians in violation of Article 120(1) of the Basic Criminal Code of the RC and sentenced to eight-year imprisonment. Due to the unavailability of the convicted Glavaš to the judicial bodies of the Republic of Croatia, that is, his relocation to Bosnia and Herzegovina, on 24 August 2010 the RC Ministry of Justice sent a petition to take over the execution of the sentence of imprisonment pursuant to the Law on Mutual Legal Assistance in Criminal Matters and the Agreement on Legal Assistance in Civil and Criminal Matters concluded between the Government of Bosnia and Herzegovina, the Government of the Federation of Bosnia and Herzegovina and the Government of the Republic of Croatia.

 

By their final verdict, the judicial bodies of the Republic of Croatia found Branimir Glavaš guilty because, during the period from July to late December 1991, in Osijek, in his capacity as the Secretary of the Municipal Secretariat for National Defense, after he had established, equipped and armed a military unit attached to the referenced Secretariat, having acted as an effective, and thereupon, a formal commander of the defense of the city of Osijek, he acted in violation of the provisions of international humanitarian law. By violating the rules of international humanitarian law during an armed conflict, although he was obliged to do so, the convicted Glavaš failed to prevent the torturing of the civilian population, inhumane treatment and causing injuries to bodily integrity of civilians, and the application of unlawful detentions, and violations of the rules of international law during an armed conflict, ordered the killings of civilians, inhumane treatment against them and their unlawful confinement.
