The Panel of the Appellate Division of the Court of Bosnia and Herzegovina sent out, on 29 June 2026, a second-instance judgment in the case of Miodrag Malić, dismissing as ill-founded the appeal filed by the BiH Prosecutor’s Office and the appeal of the accused’s defense counsel, and upholding the Judgment of the Court of BiH, No. S1 2 K 049964 25 K of 26 January 2026.
The first-instance judgment of the Court of BiH found the accused Miodrag Malić guilty of the criminal offense of Provoking Ethnic, Racial and Religious Hatred, Discord and Intolerance under Article 145.a(6) of the Criminal Code of BiH, for which offense the Court sentenced the accused, by applying the relevant statutory provisions, to three (3) years in prison.
The accused Miodrag Malić is found guilty that, on 2 November 2022, in Banja Luka, in front of the building of the Radio Television of Republika Srpska, at the protest organized by the opposition political parties, in the manner specified in the indictment, he glorified persons convicted for genocide, crimes against humanity or war crimes under final decisions of the International Criminal Tribunal for criminal prosecution of persons responsible for grave violations of international humanitarian law committed in the territory of the former SFR Yugoslavia since 1991, and by having consented to such a consequence, he provoked anxiety also in H.S. considering his knowledge about the hardships of Bosniak civilians in the past war in Bosnia and Herzegovina, where he still lives, and considering the participation of the referenced convicted persons in those acts.
