Indictment confirmed in Zdravko Kandić et al.

On 7 February 2022, the Court of Bosnia and Herzegovina confirmed the Indictment issued by the Prosecutor's Office of Bosnia and Herzegovina on 1 February 2022, charging the accused Zdravko Kandić, Dragan Đurđić, Dragan Ivanišević, Goran Došlo, Milan Trifković, Siniša Kandić, Dragoslav Aćimović, Mladen Kandić and Damir Antelj with the criminal offense of Crimes against Humanity under Article 172(1)h), as read with Subparagraphs a), e), f), g), i) and k), all as read with Article 21(2) and Article 29, all as read with Article 180, Paragraphs 1 and 2, of the Criminal Code of Bosnia and Herzegovina, and the accused Zdravko Kandić also with the criminal offense of War Crimes against Prisoners of War under Article 175, Subparagraph a), as read with Article 180(1) CC BiH.

According to the Indictment, the accused Zdravko Kandić, Dragan Đurđić, Dragan Ivanišević, Goran Došlo, Milan Trifković, Siniša Kandić, Dragoslav Aćimović, Mladen Kandić and Damir Antelj, in a period between June 1992 and August 1992, during the war and armed conflict in BiH, within a widespread and systematic attack by the Army of Republika Srpska and the Ministry of Interior of Republika Srpska against the non-Serb civilian population in the territory of Nevesinje municipality and the villages of Zijemlje and Ruište in the Mostar municipality, knowing of the attack and that their actions form a part of the attack, persecuted the non-Serb civilian population, acting with a discriminatory intent on ethnic and religious grounds, by way of killings, enforced disappearance, imprisonment or other severe deprivation of physical liberty, in violation of the basic rules of international law, by rape, torture and other inhumane acts of similar nature, committed with the intent to inflict great suffering.

According to the facts presented in the confirmed Indictment, the accused had the official capacity as follows:

  • Zdravko Kandić – Commander of the 5th Battalion, 8th Motorized Herzegovina Brigade – Nevesinje Brigade of VRS, and Assistant Chief of Staff for Intelligence Affairs at the Nevesinje Brigade;
  • Dragan Đurđić – Deputy Commander of the 5th Battalion, 8th Motorized Herzegovina Brigade – Nevesinje Brigade of VRS and Commander of the Intervention Platoon of 5th Battalion;
  • Dragan Ivanišević, Milan Trifković and Goran Došlo – members of the Intervention Platoon of the 5th Battalion, 8th Motorized Herzegovina Brigade – Nevesinje Brigade of VRS;
  • Dragoslav Aćimović, Siniša Kandić and Mladen Kandić – members of the SJB Mostar Reserve Police Unit, under command of the 5th Battalion, 8th Motorized Herzegovina Brigade – Nevesinje Brigade of VRS;
  • Damir Antelj – member of the 5th Battalion, 8th Motorized Herzegovina Brigade – Nevesinje Brigade of VRS;
