Indictment confirmed in Sead Arnautović et al.

On 29 January 2026, the Court of Bosnia and Herzegovina confirmed the Indictment in the case of Sead Arnautović et al., which charges the accused Sead Arnautović and Samir Mehinović that, by the acts described in the Indictment, the accused Sead Arnautović committed the criminal offense of War Crimes against Prisoners of War under Article 175(1)a) of the Criminal Code of Bosnia and Herzegovina (CC BiH), in conjunction with Article 180(2) CC BiH, while the accused Samir Mehinović committed the criminal offense of War Crimes against Prisoners of War under Article 175(1)a) CC BiH, in conjunction with Article 21(2) CC BiH.

The accused are, inter alia, charged with having acted contrary to the rules of international humanitarian law during the war in Bosnia and Herzegovina and the armed conflict between members of the Army of BiH and the Army of Republika Srpska (VRS), in the territory of the municipality of Doboj, in the period from 10 July 1992 until 15 July 1992 at the latest, namely Sead Arnautović, in his capacity as commander of the 109th Doboj Brigade of the Army of BiH (Brigade), and Samir Mehinović, in his capacity as commander of a platoon of the Military Police of the aforementioned brigade (Platoon), in such a way that the accused Arnautović, as a superior officer, knew and had reason to know that his subordinates were committing torture and inhumane treatment of prisoners of war, which also caused the death of one prisoner of war, yet he failed to prevent the commission of the criminal acts and to punish their perpetrators, while the accused Samir Mehinović, as a person responsible for the supervision and protection of prisoners of war in the detention facility located within the Brigade in the building of the "old" Elementary School in the town of Klokotnica, Doboj municipality, knowingly failed to supervise the detention, even though he knew that torture and inhumane treatment were being committed there, which caused the death of one person, thereby enabling and facilitating the commission of criminal offenses.
