On 30 December 2025 the Court of Bosnia and Herzegovina confirmed the indictment in the case of Mirsad Šestić, which charges the accused Mirsad Šestić with the criminal offenses of War Crimes against Civilians under Article 173 CC BiH and War Crimes against Prisoners of War under Article 174 CC BiH.
The accused is inter alia charged that on 16 August 1993, during the armed conflict between the Army of the Republic of Bosnia and Herzegovina (ARBiH) on the one side and members of the Croat Defense Council (HVO) on the other, in his capacity as commander of the 2nd Battalion of the 303rd Mountain Brigade of the Army of BiH, he ordered subordinate members of the brigade to carry out an attack on the place Kiseljak, which belongs to the village of Orahovica, municipality of Žepče, during which members of the RBiH Army killed six civilians, mostly elderly, including two women and a 13-year-old girl, and wounded three Croat women.
Furthermore, the accused is charged with having ordered the capture of civilians during the attack for the purpose of exchanging them for captured members of the ARBiH, and with having ordered the formation of a “human shield” consisting of about twenty civilians, including minors and children, fully aware that those civilians could be killed or injured as a result of his orders. The accused is also charged with the capture, abuse and infliction of bodily harm on a captured civilian who was working as a journalist.
