On completion of trial in the case of Vojin Pavlović (S1 2 K 047294 24 K), on 22 May 2025 the Court of Bosnia and Herzegovina delivered and pronounced a Trial Judgment, finding the accused Vojin Pavlović guilty of the criminal offense of Provoking Ethnic, Racial and Religious Hatred, Discord and Intolerance under Article 145.a(6) of the Criminal Code of Bosnia and Herzegovina (CC BiH) and the criminal offense of Provoking Ethnic, Racial and Religious Hatred, Discord and Intolerance under Article 145a(4), as read with Paragraph 3, of the CC BiH.
The Court imposed on the accused the sentences as follows:
- concerning the criminal offense of Provoking Ethnic, Racial and Religious Hatred, Discord and Intolerance under Article 145a(6) CC BiH – two years and two months of imprisonment;
- concerning the criminal offense of Provoking Ethnic, Racial and Religious Hatred, Discord and Intolerance under Article 145a(4), as read with Paragraph 3, of the CC BiH – up to ten months of imprisonment,
so the court, applying the relevant legal provisions, ultimately imposed on the accused a compound sentence of two (2) years and six (6) months of imprisonment.
Under Section 1 of the operative part of the Judgment, the accused Vojin Pavlović was found guilty of having, on 10 March 2023, in Bratunac, at the intersection of Gavrila Principa and Sveti Sava streets in the city center, together with unidentified persons known to him, placed a banner with the image of the former commander of the Republika Srpska Army Ratko Mladić above the traffic light, on which banner was written the message “Happy birthday, and may you have a long and healthy life,” being aware, both as the president of the board of directors of the "Eastern Alternative" Association of Republika Srpska, and as a resident of Bratunac, that by the said action he glorifies the image of Ratko Mladić, who was convicted by a final judgment of the International Tribunal for the former Yugoslavia (ICTY) for the crime of genocide, and that such actions of his could cause ethnic, religious hatred, discord and intolerance. It is further said that the accused, agreeing to such a consequence, placed the aforementioned banner in a public place, the content of which caused anxiety and fear among some of the residents in that area, and especially among the Bosniak returnees to the surrounding villages in the Bratunac municipality, including S.A. and A.M.
It is further alleged that under Section 2 of the operative part of the Judgment the accused, as the president of the Citizens' Association "Eastern Alternative", from June 2023 to 12 July 2023, approved and attempted to justify the crime of genocide by organizing a public gathering for which he made posters that read: "11 JULY - THE DAY OF THE LIBERATION OF SREBRENICA; THANK YOU THE ARMY OF REPUBLIKA SRPSKA", which he pasted in the area of the Bratunac municipality, which borders the Srebrenica municipality, thus making them accessible to the residents of the Bratunac municipality, as well as to all other persons residing in the areas of the Srebrenica and Bratunac municipalities in days before and around 11 July, which public gathering was then held on 11 July 2023 on Miloš Obilić Square, Bratunac, at which Vojin Pavlović gave a speech, and nationalist music was played publicly, although he was aware that final judgments had been issued before the International Criminal Tribunal for the former Yugoslavia in the cases against Radovan Karadžić and Ratko Mladić, establishing the commission of the criminal act of genocide against Bosniaks in the territory of the Srebrenica municipality, and he was also aware that it was precisely 11 July that was designated by the aforementioned judgments as the day of the commission of the criminal act of genocide, on which date the commemoration and burial of the identified victims of the genocide in Srebrenica are held every year, at which a large number of people gather, so that holding a rally entitled "11 JULY - THE DAY OF THE LIBERATION OF SREBRENICA; THANK YOU THE ARMY OF REPUBLIKA SRPSKA" on that very day could incite violence or hatred directed against the Bosniak people or individual members of the Bosniak people, all of which caused anxiety and fear among some residents in that area, especially among the Bosniak returnees in the territory of the Bratunac municipality, including V.D., S.A., H.R., E.R. and E M.
