Judgment pronounced in Miodrag Malić case

On 26 January 2026 the Court of Bosnia and Herzegovina delivered and pronounced a Trial Judgment in the case of Miodrag Malić, by which the accused Miodrag Malić was found guilty that he committed the criminal offense of Provoking Ethnic, Racial and Religious Hatred, Discord and Intolerance under Article 145.a(6) CC BiH.

 

The Court sentenced him to 3 (three) years of imprisonment.

 

The accused is charged that on 2 November 2022, in Banja Luka, in front of the Republika Srpska Radio Television building, at a protest organized by opposition political parties, in the manner specified in the indictment, he glorified persons who were convicted of genocide, crimes against humanity or war crimes by final verdicts delivered by the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law, committed on the territory of the former SFR Yugoslavia since 1991, and, by agreeing to such a consequence, he also caused anxiety in H.S., given his knowledge of the suffering of Bosniak civilians in the previous war in Bosnia and Herzegovina, where he still lives, and the participation of the aforementioned convicted persons in those actions.
