Appeal Judgment delivered in Dejan Pudar case

Having completed a hearing, the Appellate Division Panel of the Court of Bosnia and Herzegovina delivered and on 17 March 2026 pronounced an Appeal Judgment in the case of Dejan Pudar, finding the accused Dejan Pudar guilty that by the acts described in the operative part of the Judgment he committed the criminal offense of Embezzlement in Office under Article 221(3), as read with  Paragraph 1, of the CC BiH, in conjunction with Article 54 CC BiH.

The Court sentenced the accused Dejan Pudar to 5 (five) years of imprisonment.

 

By the same Judgment, the Court partially granted the redress claim filed by the injured party – the Bosnia and Herzegovina Air Navigation Services Agency (BHANSA), and imposed an obligation on the accused to pay to the injured party damage compensation in the amount of 262,542.33 BAM.

The accused was found guilty that, in the period from 1 January 2014 to late November 2015, as the person authorized to withdraw and dispose of funds at the BiH Air Navigation Services Agency (BHANSA), and as the chief cashier responsible for collections, payments and the balance of cash in the cash registers, i.e. the money entrusted to him, in the manner described in detail in the operative part of the Judgment, with the aim of obtaining unlawful material gain, he took from the withdrawn money entrusted to him in the service of BHANSA, and appropriated for himself, the amount of 262,542.33 BAM, by forging the accounts of the legal entity "Mrkulić Company" d.o.o. Sarajevo, cashier's orders for the payment of advances and orders for official trips of BHANSA for other BHANSA employees and himself, thus creating the alleged basis for the payments of the amounts of money indicated in these false documents, in which way he appropriated for himself the said amount.

 

No appeal lies from this Judgment.
