The Suspects in the Case of Viktor Krišto and Others Ordered in Custody and the Prohibitive Measures Imposed

The Court of Bosnia and Herzegovina (the Court) issued, on 19 May 2023, a decision in the case of Viktor Krišto et al. (S1 2 K 036890 20 Krn) granting a motion of the Prosecutor’s Office of BiH of 19 May 2023 in relation to the suspect Viktor Krišto, and ordered the suspect Viktor Krišto in custody. Pursuant to the said decision, custody can last no longer than one month after the arrest, that is from 17 May 2023 to 17 June 2023, or until a new Court’s decision, all on the grounds of the existing custody reasons set forth in Article 132(1) a) and b) of the CPC BiH, that is, due to a risk of flight, fear that the suspect will destroy, conceal, alter or forge the evidence and clues relevant to the proceedings, or exert influence on the witnesses, accomplices or concealers.

Under the same decision, the Court dismissed the Prosecution’s motion of 19 May 2023 to order the suspect Mehmed Bojić in custody. The Court imposed on the suspect Mehmed Bojić the following prohibitive measures:

 

  • ban on leaving the place of residence, namely house arrest;
  • travel ban; and
  • prohibition from meeting with certain persons.

 

The imposed prohibitive measures can stay in force as long as necessary, or until a new Court’s decision. The justifiability of the imposed measures will be reviewed upon expiration of each two (2) months. The suspect was specially cautioned that he can be ordered into custody should he fail to comply with the imposed prohibitive measures.

The suspects Viktor Krišto and Muhamed Bojić have been suspected of commission of the criminal offense of Organized Crime under Article 250 of the Criminal Code of Bosnia and Herzegovina (CC BiH), in connection with the criminal offenses of Illicit Trafficking in Narcotic Drugs under Article 195 of the CC BiH and Illicit Trade in Weapons, Military Equipment and Products of Dual Use under Article 193 of the CC BiH.
