Slavko Savić Sentenced to 8 (eight) Years in Prison

Having completed the main trial, the Trial Panel of Section I for War Crimes of the Court of Bosnia and Herzegovina rendered, on 29 June 2015, a Verdict finding the accused Slavko Savić guilty of the criminal offense of War Crimes against Civilians under Article 142(1) of the Criminal Code of the Socialistic Federative Republic of Yugoslavia (CC SFRY). Applying the referenced Article 142(1) of the CC SFRY and Article 285 of the Criminal Procedure Code of BiH (CPCP BiH), as well as Articles 33, 38 and 41 of the CC SFRY, the Court of BiH imposed on the accused Slavko Savić a prison sentence for a term of 8 (eight) years.

Kenan Frndić Ordered into Custody

On 26 June 2015, the Court of Bosnia and Herzegovina partially granted the motion of the Prosecutor's Office of Bosnia and Herzegovina and rendered a decision in the case of Elvis Salčinović et al. ordering the suspect Kenan Frndić into one-month custody. The custody pursuant to this Decision may last until 25 July 2015.

Accused in Luka Dragičević et al. plead not guilty

At the plea hearing held before Section I for War Crimes of the Court of Bosnia and Herzegovina, the accused Luka Dragičević, Boban Inđić, Obrada Poluga, Novak Poluga, Dragan Šekarić, Oliver Krsmanović, Petko Inđić, Radojica Ristić, Vuk Ratković and Mićo Jovičić all entered a not guilty plea.
The Suspects in Elvis Salčinović et al. Ordered into Custody

Deciding upon a motion filed by the Prosecutor’s Office of Bosnia and Herzegovina, the Court of Bosnia and Herzegovina issued today, 25 June 2015, a decision in Elvis Salčinović et al. ordering the suspects: Elvis Salčinović, Denis Hamidović, Toni Hamidović and Luka Hrustić into custody for a term of one month. Custody pursuant to this decision may last no longer than 23 July 2015.

First Instance Verdict Pronounced in Bosiljko Marković et al.

Following the completion of the main trial, the Trial Panel of Section I for War Crimes of the Court of Bosnia and Herzegovina pronounced on 24 June 2015 a verdict finding the Accused Bosiljko Marković and Ostoja Marković guilty of the criminal offense of War Crimes against Civilians in violation of Article 142(1) of the Criminal Code of the Socialist Federal Republic of Yugoslavia (CC SFRY), as read with Article 22 of the CC SFRY. In the application of the cited provisions and Articles 33, 38 and 41 of the CC SFRY, for the referenced criminal offense the Court of B-H sentenced the Accused Bosiljko Marković to imprisonment for the term of 10 (ten) years and the Accused Ostoja Marković to imprisonment for the term of 10 (ten) years.

Panel of Section II for Organized Crime, Economic Crime and Corruption of the Appellate Division of the Court of Bosnia and Herzegovina sent out on 16 June 2015 a Verdict dated 15 May 2015 whereby it refused as unfounded the Appeals filed by the respective Defense Counsel for the Accused Savaš Ereren, Predrag Đurđević, Šaban Grbo, Petar Mijačević-Pejić, Karson Dominković and Nikola Miličić, while it granted the Appeal by the Prosecutor's Office of Bosnia and Herzegovina and, hence, revoked the Verdict of the Court of B-H No. S1 2 K 013017 13 K of 26 November 2014 in the acquittal part and ordered holding of a hearing before the Appellate Panel with respect to that part, while in the sentencing part the Court revised the Verdict with respect to the legal definition of the offense and the decision on criminal sanction, by providing the following legal definition for the acts that the Accused were found guilty of by the first instance Verdict: with respect to Savaš Ereren, the criminal offense of Organized Crime in violation of Article 250(3) of the Criminal Code of Bosnia and Herzegovina (CC B-H), as read with the criminal offense of Smuggling of Persons in violation of Article 189(4) as read with Paragraph 1 of the CC B-H, and as read with Article 54 of the CC B-H; the Accused Predrag Đurđević, a continued criminal offense of Smuggling of Persons in violation of Article 189(4), as read with Paragraphs 3 and 1 of the CC B-H, and as read with Article 54 of the CC B-H; the Accused Šaban Grbo as the criminal offense of Smuggling of Persons in violation of Article 189(4), as read with Paragraphs 3 and 1 of the CC B-H, and as read with Article 54 of the CC B-H; the Accused Petar Mijačević-Pejić as the criminal offense of Smuggling of Persons in violation of Article 189(3) as read with Paragraph (1) of the CC B-H, and as read with Article 54 of the CC B-H; the Accused Karson Dominković, as the criminal offense of Smuggling of Persons in violation of Article 189(3), as read with Paragraph 1 of the CC B-H, and as read with Article 54 of the CC B-H; the Accused Nikola Miličić, as the Smuggling of Persons in violation of Article 189(4) as read with Paragraphs 3 and 1 of the CC B-H, and as read with Article 54 of the CC B-H. In that respect the Accused Savaš Ereren was sentenced to imprisonment for a term of 11 (eleven) years, the Accused Predrag Đurđević to imprisonment for a term of 4 (four) years, the Accused Šaban Grbo to imprisonment for a term of 1 (one) year and 6 (six) months, the Accused Petar Mijačević-Pejić to imprisonment for a term of 1 (one) year, the Accused Karson Dominković to imprisonment for a term of 1 (one) year, and the Accused Nikola Miličić to imprisonment for a term of 1 (one) year and 6 (six) months.

The Court of Bosnia and Herzegovina confirmed, on 22 June 2015, an Indictment in Senad Šabić et al., which charged the accused Senad Šabić and Ramo Brkić with committing the criminal offense of Giving Gifts and Other Forms of Benefits under Article 218(1) of the Criminal Code of BiH (CC BiH), as read with Article 29 of the CC BiH, and the accused Azra Miletić with committing the criminal offense of Accepting Gifts and Other Forms of Benefits under Article 217(1) of the CC BiH and the criminal offense of Violation of Law by a Judge under Article 238 of the CC BiH, as read with Article 53(1) of the CC BiH.

Vaso Ljubibratić sentenced to 13 years in prison

Following a public hearing, the Panel of Section II for Organized Crime, Economic Crime and Corruption of the Court of Bosnia and Herzegovina has delivered and on 16 June 2015 publicly pronounced a verdict finding the accused Vaso Ljubibratić guilty that by the actions described in Sections 2 and 3 of the Operative Part of the Verdict he committed the criminal offense of Organized Crime under Article 250(2) of the CCBiH, as read with the criminal offense of Aggravated Robbery under Article 289(2) of the Criminal Code of the Federation of Bosnia and Herzegovina (CC FBiH), for which he was sentenced to 13 (thirteen) years of imprisonment. The same verdict acquitted the accused Vaso Ljubibratić of the charges that by the actions described in Section 1 of the Operative Part of the Verdict he committed the criminal offense of Organized Crime under Article 250(2) of the CC BiH, in conjunction with the criminal offense of Murder under Article 148(1) of the CC RS, as read with Article 25 of the CC RS.

On 12 June 2015, the Court of BiH confirmed the Indictment issued by the BiH Prosecutor's Office, charging the accused Zijad Turković with the criminal offense of Attack against the official person on tasks of security, detection and apprehension of perpetrators of criminal offences under Article 241b(2) as read with Paragraph 1 of the Criminal Code of Bosnia and Herzegovina, and the criminal offense of Attack against the official person on tasks of security, detection and apprehension of perpetrators of criminal offences under Article 241b(1) of the Criminal Code of Bosnia and Herzegovina, all in conjunction with Article 53 of the Code (concurrence of criminal offenses).
