Ratko Dronjak sentenced to 15 years of imprisonment

On 11 February 2015 the Appellate Division Panel of Section I for War Crimes of the Court of Bosnia and Herzegovina sent out the second-instance verdict in the Ratko Dronjak case, reversing the verdict of the Court dated 21 February 2013 in the part concerning the application of substantive law and decision on sentence, by legally qualifying the actions described in Sections III-5, III-6, III-7, III-8, III-9, III-10, III-11, III-12, III-13, III-14, which the mentioned verdict found Ratko Dronjak guilty of, as the criminal offense of War Crimes against Prisoners of War under Article 144 of the Criminal Code of SFRJ, so the accused is sentenced to a compound sentence of 15 years of imprisonment. In the remaining part, the verdict of the Court of BiH dated 21 February 2013 shall remain undisturbed. No appeal lies from this verdict.

Second-instance verdict sent out Second-instance verdict sent out

The Panel of the Appellate Division of Section I for War Crimes sent out on 10 March 2015 the second-instance Verdict in the case of Milun Kornjača, dismissing the appeal filed by the Defense for the accused Milun Kornjača in relation to the convicting part of the Verdict in its entirety as unfounded and thus confirming the first-instance Verdict of the Court of BiH in this part. The Appellate Panel also dismissed the Prosecution's appeal in relation to paragraph 1g) of the acquitting part of the same Verdict and the decision on sentence, thus confirming the first-instance Verdict in this part. The Prosecution's appeal is granted in relation to paragraphs 1l) and 1n) of the disposition of the acquitting part of the Verdict, and hence the Appellate Panel revoked the first-instance Verdict in this part ordering a retrial before the Appellate Panel of Section I for War Crimes of the Court of Bosnia and Herzegovina.

Following the conclusion and acceptance of the Guilty Plea Agreement, a Judge in the Section II for Organized Crime, Economic Crime and Corruption of the Court of Bosnia and Herzegovina handed down and publicly announced on 24 March 2015, the Verdict under which the Accused Nenad Petrović, in Paragraph 1 of the Verdict, is found guilty of the continued criminal offense of Embezzlement in Office in violation of Article 221(2) as read with Paragraph (1) and Article 54 of the Criminal Code of Bosnia and Herzegovina, and the Accused Mićo Trifković, in Paragraph 2 of the Verdict, is found guilty of the continued criminal offense of Embezzlement in Office - accessory in violation of Article 221(2) as read with Paragraph (1) and Article 54 and Article 31 of the Criminal Code of Bosnia and Herzegovina. To that regard, the Court sentenced the Accused Nenad Petrović to a prison term of nine (9) months, and the Accused Mićo Trifković to a prison term of six (6) months.

Josip Tolić sentenced to 10 years of imprisonment

Having completed the main trial, on 20 March 2015 the first-instance panel of Section I for War Crimes of the Court of Bosnia and Herzegovina delivered a verdict finding the accused Josip Tolić guilty of the criminal offense of War Crimes against Civilians under Article 142(1) of the Criminal Code of the Socialist Federative Republic of Yugoslavia (CC SFRJ), as read with Article 22 of the same Code. In that regard, the Court sentenced the accused Tolić to 10 (ten) years of imprisonment.

The Panel of the Appeals Division of the Section II for Organized Crime, Economic Crime and Corruption of the Court of Bosnia and Herzegovina handed down on 20 March 2015 the Appeals Verdict under which the Accused Mijo Golub is acquitted of the charges for the criminal offense of Abuse of Office or Official Authority in violation of Article 220(3) as read with Paragraph (1) and the criminal offense of Disclosure of Secret Data in violation of Article 164(2) of the Criminal Code of Bosnia and Herzegovina (CC of BiH), all in conjunction with Article 53 and Article 54 of the CC of BIH.
Mirsad Šijak sentenced to 7 years and 9 months in prison

On 17 March 2015, the Appellate Division Panel of Section I for War Crimes of the Court of Bosnia and Herzegovina issued a second-instance verdict in the Mirsad Šijak case, partly granting the appeal filed by the sentenced person Mirsad Šijak, so the verdict of the Court of BiH dated 24 December 2014 is modified in terms of the decision on compound sentence, so that, pursuant to Article 53(2)b) of the Criminal Code of Bosnia and Herzegovina, Mirsad Šijak is now given a compound sentence of imprisonment of 7 (seven) years and 9 (nine) months; pursuant to Article 56 of the CC BiH, the time he spent serving the prison sentence imposed by the verdict of the Supreme Court of the BiH Federation, No. 070-0-KŽK-08-000016 dated 2 April 2009, which became final on 27 January 2010, in the duration of 1 (one) year, and the hitherto served sentence of imprisonment under the verdict of the Court of BiH, No. S1 1 K 007209 12 Kri dated 18 January 2013, final as of 15 November 2013, shall be credited toward his compound sentence.

Appeals Second-Verdict in the case v. Abduladhim Maktouf sent out

The Appellate Division Panel of Section I for War Crimes of the Court of Bosnia and Herzegovina sent out a second instance Verdict No: S1 1 K 013517 14 dated 25 February 2105 in the case of Abduladhim Maktouf. Under this Verdict, the Appeal filed by the Defense Counsel for the Accused Abduladhim Maktouf was partially upheld and the first instance Verdict of 11 July 2014 was revised in the part of the decision to render the verdicts partially ineffective and in the decision on the sentence by rendering partially ineffective the second instance Verdict of the Court of BiH No: KPŽ-32/05 of 4 April 2006, so that, the Accused Abduladhim Maktouf was sentenced to a prison term of 3 (three) years for the criminal offense of which he was found guilty under the Verdict that was partially rendered ineffective and which was qualified as War Crimes against Civilians under Article 142(1) of the adopted Criminal Code of the Socialist Federal Republic of Yugoslavia, taken over pursuant to the Law on the Application of the Criminal Code of the Republic of BiH and the Criminal Code of SFRY (the adopted CC of SFRY), as read with Article 24 of the same Law. The prison sentence was imposed on the Accused pursuant to Articles 33, 34, 38, 41, 42(1) ands 43(1) of that law. The appealed Verdict remained unchanged in the remaining part. No appeal lies from this Verdict.
Suspects in the case v. Osman Abdel Salam et al. ordered into custody

Deciding upon the Motion of the Prosecutor's Office of Bosnia and Herzegovina to order custody, the Court of Bosnia and Herzegovina rendered the Decision dated 16 March 2015 granting the Prosecution Motion and ordering the Suspects Osman Abdel Salam, Amar Šljivo, Adis Ramić and Enver Džanko into custody. Under the said Decision, the custody may last until 13 April 2015 or pending a new Decision.

Court of BiH denies appeals from decision to order custody of suspects in the case of Azra Miletić et al.

Deciding on the appeals filed in the criminal case of Azra Miletić et al., the Criminal Division of the Court of Bosnia and Herzegovina refused as ill-founded the appeals filed by the suspects Azra Miletić, Senad Šabić and Ramo Brkić, as well as the appeal filed by the Prosecutor's Office of Bosnia and Herzegovina. The appeals were filed from the Decision of the Court of BiH dated 28 February 2015 ordering one-month custody of the suspects in the case.
