Custody of Zulfikar Ališpago terminated and prohibiting measures imposed

Deciding upon the Motion filed by the Defense Counsel for the Accused Zulfikar Ališpago, the Court of Bosnia and Herzegovina accepted the bail in the total amount of KM 530,171.00 and rendered the Decision on 13 July 2012 in the case v. Mensur Memić et al. terminating custody of the Accused Zulfikar Ališpago and ordering the following prohibiting measures:

 

1.     Prohibition from leaving the place of residence (house arrest)- the relevant police department will organize controls of the Accused on a daily basis;

2.     Travel ban including temporary withdrawal of all travel documents issued to the name of the Accused, along with the prohibition of issuance of new travel documents, as well as the prohibition to use the identity card for crossing the state border of Bosnia and Herzegovina;

3.     Ban on contacting, meeting and any kind of association with, including a ban on getting closer than 100 m to the co-Accused, witnesses listed in the Indictment and other persons who have any information about the present case.

 

The imposed prohibiting measures may last as long as necessary, while the review of their justifiability shall be carried out on a bimonthly basis.

 

If the Accused violates any of the imposed prohibiting measures, he may be ordered back into custody.

 

Zulfikar Ališpago is charged with the criminal offence of War Crimes against Civilians and the criminal offense of War Crimes against Prisoners of War, and has been held in custody from 3 February 2010.
