Šaban and Elvir Đelilbašić sentenced to six-year imprisonment each

The Panel of the Criminal Division of Section I for War Crimes of the Court of Bosnia and Herzegovina, following the discussion and acceptance of the Guilty Plea Agreement concluded between the Prosecutor’s Office of BIH and Defendants Šaban and Elvir Đelilbašić, found the Defendants guilty of the criminal offense of War Crimes against Civilians in violation of Article 173 (1) (c) of the Criminal Code of Bosnia and Herzegovina (CC of BiH), as read with Article 29 and Article 180 (1) of the CC of BIH. The Trial Panel sentenced them for the said criminal offense to six-year imprisonment each.

 

The Defendants Šaban Đelilbašić and Elvir Đelilbašić were found guilty because during the armed conflict between the Army of Republic of Bosnia and Herzegovina and Army of Republika Srpska, as members of the 3rd Battalion within the 312 Motorized Brigade, the so-called Turbetanski Detachment of the Army of RBIH, on 9 December 1992, having been informed that their brother got killed at the front-line in the combat against the Army of Republika Srpska, they both got armed with automatic rifles and, with the intention to kill citizens of Serb ethnicity who lived in Turbe, deprived two persons of Serb ethnicity of their lives.  In the morning hours of the aforementioned day, the Defendants arrived in front of a family house of a certain person in the place of Turbe and shot and killed a citizen of Serb ethnicity from their automatic rifles.  Thereafter, they went towards a house of another citizen whom they found in a close vicinity to the house, after which they shot and killed the other citizen of Serb ethnicity from their automatic rifles.
