
The accused were found guilty because in June and July 1995 during the armed conflict in the Republic of Bosnia and Herzegovina, within which members of the Army of Republika Srpska (VRS) and the Ministry of Interior of Republika Srpska (MUP RS) launched a widespread and systematic attack against the Bosniak civilian population of the UN Safe Area of Srebrenica, as a part of which up to 40,000 Bosniak civilians were forcibly transferred from the Srebrenica Enclave while more than 7,000 Bosniak men and boys were summarily executed, and having been aware of the attack and that their acts were a part of the attack, as members of the 10th Sabotage Detachment of the Main Staff of VRS together with other units of VRS and MUP, the accused carried out the persecution of Bosniak population of the UN Safe Area of Srebrenica on national, ethnic and religious grounds, depriving other persons of their lives.
The accused were found guilty because in late June 1995, they launched the first attack on the UN Safe Area of Srebrenica with the aim of causing anxiety among the Bosniak population to make them leave Srebrenica, and starting on early morning of 11 July 1995, upon an order of the Commander of the 10th Sabotage Detachment of the VRS Main Staff, Milorad Pelemiš, together with other members of the 10th Sabotage Detachment and other units of VRS, they launched the second attack by taking part in the take-over of the UN Safe Area of Srebrenica, and, having entered the town, one of the members of the 10th Sabotage Detachment slaughtered a Bosniak civilian man. Following the take-over of Srebrenica by the Bosnian Serb forces and after the entire Bosniak population had been expelled from the Safe Area, on 16 July 1995, between 10:00 and 15:00 hours, during which time around 800 Bosniak men were brought from the school in the village of Gornja Pilica, Zvornik Municipality to the Branjevo Farm, near the village of Pilica, as the execution site, the accused Franc Kos, Stanko Kojić, Zoran Goronja and Vlastimir Golijan together with several other members of the 10th Sabotage Detachment shooting from automatic rifles, and Stanko Kojić also shooting from a pistol, and Zoran Goronja from an M-84 machine gun, with the aim of depriving them of their lives, in that location summarily executed around eight hundred captured Bosniak men from the Srebrenica Enclave aged between 18 and 60, some of whom were blindfolded and had ligatures on their hands. After that Franc Kos and Stanko Kojić, together with another member of the 10th Sabotage Detachment, killed the survivors shooting them in the head to make sure that no one survived. Nevertheless, two men survived the execution.
