Factual allegations in the indictment:

It is alleged in the Indictment that during the armed conflict between the Army of BiH and the HVO, as a member of the 1st Company of the 1st Battalion of the 17th Krajina Brigade of the Army of BiH, on 9 June 1993 the accused Jakupović came armed into a building in the village of Slimena, Travnik Municipality, where Croat men from the village of Slimena were detained, and where the accused Jakupović shot dead from a close range a member of the HVO Unit for Special Purposes Vitezovi who was among the detainees.

Counts in the indictment:

Elvir Jakupović is charged with War crimes against prisoners of war pursuant to Article 175 (a) of the Criminal Code of Bosnia and Herzegovina in conjunction with Article 180 (1) (individual criminal responsibility).

Course of the proceedings:

The indictment was confirmed on 16 June 2010.

At the plea hearing held before Section I for War Crimes of the Court of BiH on 8 July 2010, Elvir Jacupović pleaded not guilty.

On 23 August 2010 the Court of Bosnia and Herzegovina, having considered and accepted the plea agreement between the Prosecutor's Office of BiH and the accused Elvir Jakupović, pronounced a verdict, finding the accused Jakupović guilty of the criminal offense of War Crimes against Prisoners of War under Article 175 (1) a) of the criminal Code of Bosnia and Herzegovina as read with Article 180 (1) of the same Code. The Court sentenced the accused to imprisonment for a term of five years.
