Factual allegations in the indictment:

As inter alia alleged in the Indictment, the accused Kornjača in the capacity of the Commander of the Paramilitary Unit “Plavi orlovi”; the accused Živković in the capacity of the Head of the Public Security Station of Čajniče and a member of the Crisis Staff; the accused Tadić as a member of the Paramilitary Unit “Plavi orlovi”, as knowing participants of the joint criminal enterprise, carried out the prosecution of Moslem civilians in the Čajniče Municipality. The accused allegedly took part in the unlawful capture and detention of Moslem civilians who were exposed to torture and other inhumane actions. As the Indictment further alleges, on or about 19 May 1992, following the death of one of the members of the Paramilitary Unit “Plavi orlovi”, the accused took part in the killing of 11  detained civilians in “Lovački dom” by shooting from fire arms and throwing hand grenades.

Charges in the indictment:

Milun Kornjača, Milorad Živković and Duško Tadić are charged with the criminal offense of Crimes Against Humanity pursuant to Article 172(1)(h) in conjunction with items (a)(e)(f)(i)(k) of the Criminal Code of Bosnia and Herzegovina (CC BiH) in conjunction with Article 180(1) of the CC BiH.

Course of the proceedings:

The Court confirmed the indictment on 8 June 2010.

At the plea hearing held on 1 July 2010 before Section I for War Crimes of the Court of Bosnia and Herzegovina (BiH) in the Milun Kornjača et al. case all the accused pleaded not guilty.
