On 19 April 2010 the Court ruled to join the case against J.D. et al. (X-KR-09/823-1) with the case against I.N. (X-KR-08/654-1), thus from that point onwards this case refers to all the accused persons: J.D., Đ.M., M.G. and I.N. and will bear a single number - J.D. et al. (X-KR-09/823-1).

On 30 October 2009 the Court of Bosnia and Herzegovina (BiH) issued a Decision ordering J.D. i Đ.M. into custody.

On 20 December 2009 the Court of Bosnia and Herzegovina (BiH) issued a Decision ordering G.M. into custody.On 21 January 2010 the Court of Bosnia and Herzegovina (BiH) issued a Decision ordering I.N. into custody. On 25 May 2012, the Court rendered a decision terminating the custody of the accused M.G. and I.N.

CASE INFORMATION

 

Factual Description of the Indictment:

 

The Indictment inter alia avers that the accused D.J., as an Assistant Commander of the S.P.B of the RS MUP and the Commander of the J.Training Centre of the S.P.B., the accused Đ.M. as a Commander of the 1st Company in the J.Training Centre and the accused M.G., as a Commander of the 2nd Platoon of the 1st Company of the J.Training Centre, commanded their units, acting both individually and in concert with other participants, planned, ordered, instigated and participated in the realization of a systematic joint criminal enterprise. In the time period from 10 July to 19 July 1995 the accused persons, as co-perpetrators, inflicted grave physical and mental injuries to the group of Bosniaks, carried out killing of Bosniak males as well as forcible transfers of women, children and elderly from the UN-protected Srebrenica safe area, with the aim to completely exterminate the national, ethnic and religious group of Bosniaks.

 

Counts of the Indictment:  

 

The Indictment charges J.D., Đ.M. and M.G. with the criminal offence of Genocide under Article 171 of the Criminal Code of Bosnia and Herzegovina (CC BiH) as read with Article 180, paragraph 1 of the BiH CC.

 

Course of the proceedings:

 

The Court confirmed the Indictment on 22 January 2010. 

 

At the plea hearing held on 19 February 2010 before the Section 1 for War Crimes of the Court of BiH all the accused entered not guilty pleas.

 

The main trial was opened on 29 April 2010.

 

On 25 May 2012 the Court pronounced the first-instance Verdict in the J.D. et al. (S1 1 K 003417 10 KrI) case finding the accused J.D. and Đ.M. guilty of the criminal offence of Genocide. In that regard, the Court imposed on the accused the following long-term prison sentences: J.D. 35 years, Đ.M. 30 years. The Court acquitted the accused I.N. and M.G. of the charges that they committed a criminal offence of Genocide.
