Factual allegations in the indictment:
According to the indictment, the accused Jovo Jandrić and Slobodan Pekez, as members of the RS Army and the reserve police, together with other people, as an organized group of armed people, organized by Jovo Jandrić, rounded up Bosniak population from Ljoljići-Čerkazovići, Jajce Municipality, with the intention to take them away and kill them at the location known as „Tisovac“. The accused, allegedly, together with other members of the group, armed with automatic and semi-automatic rifles and threatening to use them, unlawfully arrested and forcefully taken Bosniak civilians, men, women and children, out of the houses and took them all together toward the place called „Draganovac“, holding the rifles in their hands and threatening to kill anyone who tried to escape. The indictment further alleges that the civilians were verbally and physically abused, while being escorted. Upon reaching Draganovac, they were ordered to put all valuables (golden jewelry, watches and money) on a jacket. When they did so, those possessions were taken away. The indictment also alleges that after that the civilians were taken to the place called „Tisovac“ they were ordered to line up along the edge of the abyss. When they did so, the armed group fired bursts of fire, with the intention to kill them. On that occasion 13 men and 10 women were killed, including one child and three underage persons, while four people survived the execution.
Therefore, violating the rules of the International Law in times of war and armed conflict, the accused committed murder and intentional infliction of severe physical and mental pain upon people, violations of bodily integrity and plundering of property.
Counts of the indictment:
Jovo Jandrić and Slobodan Pekez are charged with the criminal offence of War Crimes against Civilians pursuant to Article 173 paragraph 1 items a) and f) of the Criminal Code of Bosnia and Herzegovina (CC BiH):
a) Attack on civilian population, settlement, individual civilians or persons unable to fight, which results in the death, grave bodily injuries or serious damaging of people’s health, and
f) Forced labor, starvation of the population, property confiscation, pillaging, illegal and self-willed destruction and stealing on large scale of property that is not justified by military needs, taking an illegal and disproportionate contribution or requisition, devaluation of domestic money or the unlawful issuance of money,
in conjunction with Article 180 paragraph 1 (individual criminal liability) of CC BiH.
