
Šefik Alić was acquitted of charges that on 5 August 1995, as alleged in the indictment, in the capacity of the Assistant for Security to the Commander of the “Hamza” Battalion, the IV Battalion of the 505th Brigade of the 5th Corps of the Army of BiH, together with other members of the Battalion and Al Harbi Tewfik, irregular soldier over whom he had effective control, he participated in the military operation dubbed “Oluja” during which four members of the Army of Srpska Krajina were captured by members of the “Hamza” Battalion, and with his actions and failures to act he initiated, committed or in some other way incited and assisted in the torture and murder of these prisoners.
Šefik Alić was also acquitted of the charges that based on the principle of command responsibility he failed to take all necessary and reasonable steps in order to ensure further safety of the prisoners, including the failure to prevent Al Harbi Tewfik from having contact with the prisoners or to punish him considering the fact that Al Harbi Tewfik killed all four prisoners.
The Court also issued a decision terminating prohibitive measures imposed on the Accused Šefik Alić on 3 October 2007.
