At the plea hearing before the Preliminary Hearing Judge of Section II for Organized Crime, Economic Crime and Corruption of the Court of Bosnia and Herzegovina (BiH), the Accused Mehmeti Ozturk pleaded not guilty. The second and third indicted, Yasar Sarmaca and Midhat Bašić, failed to enter a plea due to their plea bargaining with the Prosecutor's Office of BiH. A plea hearing for Yasar Sarmaca and Midhat Bašić has been scheduled for Wednesday 16 January 2008. Mehmeti Ozturk, Yasar Sarmaca and Midhat Bašić are charged with the criminal offense of Organized Crime in conjunction with Smuggling of Persons, while Yasar Sarmaca is also charged with Forgery of Documents.

According to the Indictment, during 2007 Ozturk Mehmeti, Yasar Sarmaca and Midhat Bašić prepared and organized the transfer of persons from the Republic of Turkey into other countries, via the territories of Bosnia and Herzegovina and the Republic of Macedonia, without complying with the regulations regarding the legal entrance and stay of migrants in other countries.
