Indictment confirmed against Šefik Alić

On 31 January 2007, the Court of Bosnia and Herzegovina (BiH) confirmed an indictment which charges Šefik Alić with War crimes against prisoners of war.

The indictment alleges that during the armed conflict on the territory of BiH and the Republic of Croatia, in the capacity of the Assistant Commander of the Hamza Battalion for Security of the 5th Corps of the Army of BiH, Šefik Alić acted contrary to the provisions of the Geneva Conventions.  According to the allegations in the indictment, the Accused, inter alia, participated in the physical and mental abuse of war prisoners, instigated their killings and failed to undertake measures to punish the perpetrators. 

The indictment further alleges that, on 5 august 1995, together with other members of the Hamza Battalion, the Accused participated in the Oluja military operation during which four members of the Army of Srpska Krajina were captured on the territory of the Republic of Croatia.  After these prisoners were captured, the Accused allegedly took custody of them.  He allegedly participated in the physical and mental abuse of these prisoners who were, according to the indictment, killed by soldiers over whom the Accused had effective control.

The indictment further alleges that the Accused failed to report the killings to his superiors and did not take any action to have the perpetrators investigated and punished.
