
In its motion seeking custody orders, the Prosecutor’s Office of BiH alleges that there is grounded suspicion that the suspect committed the criminal offence of War crimes against prisoners of war. As the deputy commander in charge of security for the „Hamza“ batallion, the suspect allegedly failed to take the necessary steps to prevent the killings of four captured soldiers of the Army of the Republic of Srpska. He also allegedly did not take any steps to punish the perpetrator. According to the Prosecutor’s motion, the suspect was present at the point of capture and questioning of these prisoners.
On the basis of the evidence submitted, the Court concluded that there was grounded suspicion that the suspect had committed the criminal offence of War crimes against prisoners of war. Further, the Court ordered custody pursuant to Article 132(1) (b) of the Criminal Procedure Code of BiH, finding that the evidence pointed to the existence of a risk that the suspect, if released, would interfere with the course of the criminal proceedings.
