Alija Osmić convicted to three years' imprisonment

Appellate Division Panel of Section I for War Crimes of the Court of BiH, having held a hearing, delivered a second instance Verdict finding the Accused Alija Osmić guilty of War Crime against Prisoners of War in violation of Article 144 of the Criminal Code of the Socialist Federal Republic of Yugoslavia (CC of SFRY), adopted pursuant to the Law on the Application of the Criminal Code of the Republic of Bosnia and Herzegovina and the Criminal Code of SFRY, and convicted him to three years' imprisonment.

 

The Accused Osmić has been found guilty because, in the period between 18 July 1993 and 19 March 1994, during an armed conflict between the Croatian Defense Council and the Army of the Republic of Bosnia and Herzegovina, as a member of the Military Police of the 307th Motorized Brigade of the Army of RBiH and as a member of the Military Police Company of the Operations Group West of the Army of RBiH, in Bugojno, in a garage of a private house in the Donjići settlement, at the Marxist Center – Nun’s Cloister, and on the premises of the BH Bank in Bugojno, he caused great suffering and serious injury to the bodily integrity of prisoners of war, thus acting in violation of the rules of international humanitarian law.

 

Under the Trial Verdict dated 4 March 2011, the Accused Osmić was found guilty of War Crimes against Prisoners of War in violation of Article 175 of the Criminal Code of BiH (CC of BiH) and sentenced to 11 years' imprisonment.

 

Having considered and granted the respective appeals by the Prosecutor's Office of BiH and Counsel for the Accused Osmić from the Trial Verdict, the Appellate Panel revoked the Verdict and ordered a retrial before the Appellate Panel.
