On 30 December 2011, the Court of Bosnia and Herzegovina confirmed the Indictment in the case v. Šaban Đelilbašić et al. under which the Accused Šaban Đelilbašić and Elvir Đelilbašić are charged with the criminal offense of War Crimes against Civilians in violation of Article 173(1)(c) of the Criminal Code of Bosnia and Herzegovina.  

The Indictment alleges, among other things, that the Accused Šaban Đelilbašić and Elvir Đelilbašić, as members of the 3rd Battalion within the 312 Motorized Brigade, the so-called Turbetanski Detachment of the Army of RBiH, shot and killed two Serb civilians in the place of Turbe.
