The Court of Bosnia and Herzegovina, having considered and accepted the Guilty Plea Agreement concluded by the Prosecutor's Office of BiH and the Accused Samir Bibić and Ismet Graca, delivered the Verdict finding Bibić and Graca guilty of the criminal offence of Organized Crime under Article 250 (2) of the Criminal Code of BiH (the CC of BiH) in conjunction with the continued criminal offence of Illicit Trafficking in Narcotic Drugs under Article 195(1) of the CC of BiH, all in conjunction with Article 54 of the CC of BiH. The Accused Samir Bibić and Ismet Graca were imposed prison sentences, more specifically, Samir Bibić was sentenced to three years and six months imprisonment and Ismet Graca was sentenced to one year and six months imprisonment. The Court also confiscated the ill-gotten proceeds from the Accused Bibić in the amount of €15.000,00, and from the Accused Graca the amount of € 3.000,00.

 

Samir Bibić and Ismet Graca were found guilty of becoming members of an organized criminal group for the purpose of acquiring a property gain and of participating in the illicit international purchase and selling, transfer, holding, import and export and sending and delivery of the intoxicating drug heroin. From February to March 2009, together with other members of the organized criminal group, the Accused participated on two occasions in the purchase and selling of the intoxicating drug heroin of 511,948 grams, and 997,041 grams respectively intended for transport, transfer and export from Bosnia and Herzegovina and import in the Republic of Croatia.

 

The Court also rendered the decision extending custody which may last until the Accused are committed to the sentence serving, and no longer than nine months.
