On 13 November 2008 the Court of Bosnia and Herzegovina (BiH) dispatched the Decision of the Appellate Panel of Section I for War Crimes of the Court of Bosnia and Herzegovina (BiH) of 29 September 2008 in the case Mirko Pekez et al., by which the Appeal filed by the Defense Counsel for the Accused Mirko (Mile) Pekez was dismissed as unfounded and the first-instance Verdict of the Court of 15 April 2008 was upheld in the part related to this Accused. The Appellate Panel of Section I for War Crimes of the Court granted the appeals filed by the Defence Counsel for the Accused Milorad Savić and Mirko (Špiro) Pekez, revoking the first-instance Verdict in the part related to these Accused, and ordered a retrial before the Appellate Panel.

On 15 April 2008 the Trial Panel found Mirko (Špiro) Pekez, Mirko (Mile) Pekez and Milorad Savić guilty of War Crimes against Civilians. Mirko (Mile) Pekez was sentenced to a long term imprisonment of 29 years, whereas Milorad Savić and Mirko (Špiro) Pekez were sentenced to a long term imprisonment of 21 years each.
