Judicial Support Section

The Legal Department of the Court of BiH provides professional assistance to judges and court panels of Section I for War Crimes and Section II for Organized Crime, Economic Crime and Corruption of the Criminal and Appellate divisions of the Court of BiH.

 

Professional assistance to judges consists of the following:

 

  • preparing cases for hearings and trials;  
  • attending and following hearings and trials (keeping the minutes of the hearings, following and recording statements by parties to the proceedings and witness statements, keeping records of the submitted documentary and physical evidence, drawing up and updating the list of witnesses who testified at the hearing etc.);
  • keeping various records pertaining to the case;
  • organizing witness testimony via video link;
  • coordinating efforts with other sections of the court, notably the Witness Support Section, Public Information and Outreach Section and the Court Management Section;
  • providing assistance to judges during deliberations;
  • doing legal research;
  • drawing up drafts of all kinds of decisions, including assistance in drafting judgments and verdicts etc.   

    In addition to the foregoing, the professional assistants will:

    • actively participate in the realization of presentations concerning the activities of the Court of BiH to all interested groups visiting the Court, as well as at  seminars, round tables and debates organized by the non-governmental sector, with a special reference to the work of the Criminal Division of the Court of BiH;
    • attend the initial, complementary and continuous education organized by the Center for Education of Judges and Prosecutors of the FBiH, the Judicial College organized by the Court of BiH,  as well as other individual or group education and training  by improving their knowledge and applying it  their everyday work on cases;
    • actively participate in and give a significant contribution to the systematization and publication of the case law in the Bulletin of the Court of BiH, which is  being issued annually.  

     

      Working on the cases falling under the jurisdiction of Sections I and II of the Criminal and Appellate divisions, Legal Department staff carry out the research of numerous legal issues in various fields of both national and international law, especially international humanitarian law, and keep track of international jurisprudence.

      Employed in the Legal Department are legal advisors, legal officers and legal trainees/interns who are assigned to teams providing support to court panels. Legal advisors coordinate and supervise the work of legal officers and legal trainees/interns.

      Legal trainees/interns perform their duties in the framework of their internship program, and are especially engaged in doing legal research of particular legal issues, offering assistance in drafting procedural decisions, and, where necessary, follow the relevant court hearings and trials.
